			<content:encoded><![CDATA[<div class="announcement_post"><div>I have been asked a lot recently about Phase 1s.  I realize there is a lot of confusion about them.  Let me try to clear the air a bit so to speak.In its simplest terms a Phase 1 is a site visit and document review of the surrounding area to determine if further investigation is advised from an environmental stand point.A Phase 1 inspection is a review of local governmental documents regarding the site to determine what the past usage of the site was along with extensive document review of the surrounding area.  It also entails a very involved and detailed site visit by a qualified professional.   In addition there is data base information that is gathered and reviewed of the surrounding vicinity to determine if there is a potential risk from an environmental stand point in the immediate area.</div>

<p>These potential risks can be anything from a past gas station on or near the site that might have contaminated the ground water to there having been a dry cleaner on the site that might have spilled chemicals into the ground.  There could have been past dumping on the site or an auto repair that did not handle the oils properly, lead in the paint, asbestos, and on and on.</p>
<p>I think you get the picture.  The focus of a Phase 1 inspection is environmental not the structure or any of the systems of the building.  The systems are the focus of the general visual inspection.  They are two separate areas of responsibility.  Both are important.  Many lending institutions require a Phase 1 clearance before they will lend money.</p>
<p>A Phase 1 inspection is an integral part to many commercial and industrial real estate transactions.  One bank that I know of will not lend for any commercial or industrial   transaction on real estate over 1.5 million dollars without a Phase I.  We are hard pressed to buy anything in the Los Angeles area in the commercial or industrial real estate area for under that.</p>
<p>There are two other aspects to a Phase 1 that may come into play depending on what is found during the Phase 1 inspection and research.  These are Phase 2 and Phase 3.  As you might assume Phase 2 and Phase 3 are the more involved aspects of the environmental field.  Phase 2 involves testing of the site such as coring into the earth and taking samples of the soil along with testing it to determine what is in the soil.  The information during a Phase 2 will determine if the site warrants further investigation and/or to be remediated.  If remediation is needed this is Phase 3.</p>
<p>Each environmental Phase whether it is Phase 1, 2 or 3, has a very involved set of industry standard requirements.   Each requires highly trained professionals to do properly. This is not an area to skimp on.  Have a reliable company with vast experience do your Phase 1 inspection.  Getting the cheapest deal for something this important I feel could easily be fiscally irresponsible.  A properly done Phase 1 inspection really is for everyones protection not just the buyer.</p>
<p>The current rate for a professionally done standard Phase 1 inspection is approx. $1800.00 - $2000.00.   Just so you understand to obtain the above mentioned documents is hundreds of dollars by itself.  The report ends up usually being hundreds of pages.  This price does not usually change unless the site gets very large and very involved.  Currently the price stated will usually handle over 90% of all commercial real estate transactions.</p>
<p>I hope this clears the air a bit on what a Phase 1 inspection is.</p>

Please save the date of May 5 and plan to attend the next Montana Wetland Council meeting in Helena.  We&#8217;ll focus on Invasive Plants in Wetland and Aquatic Areas.  I have several speakers lined up and welcome your ideas about additional presentations and speakers.<br />
 Upcoming workshops and resources include: Thanks to an EPA Wetland Program Development Grant, DEQ is developing a new lay-persons identification booklet on common wetland plants and wetland weeds in Montana which will be available this spring.<br />
The Montana Natural Heritage Program will be holding 6 field training sessions on wetland plant identification across the state in 2010, also supported by DEQ and an EPA Wetland Program Development Grant. Stay tuned for more details.<br />
Free workshops on Invasive Plant Early Detection and Rapid Response (EDRR) will be held this spring, including identification, in eastern Montana  http://www.mtweed.org/docs/2010-edrr-east.pdf and western Montana http://www.mtweed.org/docs/2010-edrr-west.pdf.<br />

The meeting was called to order by Chairman Edward Montague at 7:30 PM.</p>
<p>Agenda Item 1.   Approval of Minutes (Chairman Edward Montague).<br />
                A motion was made and voted unanimously to approve the January 26, 2010 minutes as written.<br />
 ANNOUNCEMENT<br />
                Wildlife Administrator Greg Moore started the meeting by explaining the Snow Goose Conservation Order (CO) and how hunters can obtain their Snow Goose CO Permit.  Hunters can get these free permits from the website:   www.dehip.com<br />
 Agenda Item 2.  2010-2011 Base Waterfowl Season Proposals (Greg Moore).<br />
                Mr. Moore briefly reviewed the history of the waterfowl season selection.  Mr. Moore stated that the process began at the last meeting which was in January.  Mr. Moore reviewed the proposed dates for the early seasons.<br />
                Mr. Moore provided a handout on the waterfowl season dates to the Council members and the audience. After discussion, the Council voted unanimously on the following early seasons for 2010 - 2011:<br />
 Dove (70 days)                                    Sept. 1 - Sept. 25 Oct. 16 - Oct. 30 Dec. 10 - Jan. 8 (Hours - ½ hr. before sunrise until sunset) - All segments<br />
 Resident Canada Geese                    Sept 1 - Sept. 25<br />
 Early Teal                                           Sept. 11 - Sept. 29<br />
HOURS:  Teal season will be open all day (1/2 hour before sunrise until sunset) in limited geographic areas.  These areas are coastal areas from south of the C&amp;D Canal to Lewes east of Routes 13, 113/113A &amp; 1.<br />
 After discussion, the Council voted unanimously on the following other seasons for 2010 - 2011:<br />
Youth Waterfowl Hunt                     Oct. 16<br />
Rails &amp; Gallinules &amp;                         Sept. 3 - Nov. 11   Moorhens<br />

 Agenda Item 3.   Expanding the Teal Zone (Greg Moore).<br />
                Mr. Moore stated that Division staff members had examined the proposal of expanding the early teal zone and while the Division is allowed by the U.S. Fish &amp; Wildlife Service to do so, the Division is not in favor of doing it.  Mr. Moore went on to report that aerial surveys in October indicate that there are not many teal outside of the currently established zone so expanding the current area would provide little additional harvest opportunities.  If we were to proceed with a zone expansion, we would have to put out spy blinds to determine the level of incidental harvest.  Due to the cost of conducting this surveillance, the limited number of teal beyond the current zone and the limited number of hunters that currently hunt teal each year (approximately 20%) the Division does not feel the effort and money exerted to make the change is worth it.<br />
                Mr. Moore went on to say that most of the teal seem to be held on the Prime Hook National Wildlife Refuge.  When Refuge staff were asked if they would open their duck blinds during the teal season they said no because of conflicts with non-hunters, specifically canoe/kayak users and low water levels at that time of year.  However, the Division is willing to open their eight blinds on the Prime Hook Wildlife Area during the early teal season and will work to have more blinds open on its impoundments in Kent County.<br />
 Agenda Item 4.  Legislative Update (Director Pat Emory).<br />
                Director Pat Emory explained that the Division only has two current bills and they are carryovers from the last legislative session.  They are H.B. 216 which is the elimination of the back tag requirement and H.B. 270 which allows the Division to restrict fishing activities on reef sites.  Both of these bills have passed the House and are currently scheduled for the Senate Natural Resources Committee.<br />
                Directory Emory also explained that there are several other pieces of legislation that the Division has but they have not yet been formally filed.  Director Emory could not provide any comments on them at this time.</p>
