The Board of Environmental Review is currently considering the adoption of rules incorporating by reference federal and state rule updates. In order to be included into the State Implementation Plan, public hearing notice and opportunity for comment is required. The document proposing the Board’s proposed amendment of rules is available on the website at the address included in this notice. For the final disposition of the Board of Environmental Review in this or any matter, please see the Board’s website at: http://deq.mt.gov/ber/index.asp.
 
MONTANA DEPARTMENT OF ENVIRONMENTAL QUALITY
NOTICE OF PUBLIC HEARING
 
 
  1. On September 5, 2008 at 10:00 a.m., or as soon thereafter as can be heard, the Department of Environmental Quality shall hold a public hearing in Room 111 of the Metcalf Building, 1520 E. 6th Avenue, Helena, Montana, to take public comment regarding the incorporation by reference of air quality rules currently proposed by the Montana Board of Environmental Review into the Montana State Implementation Plan (SIP).
 
  1. The proposed inclusions into the SIP would amend the incorporation by reference of certain rules to adopt the current editions of federal statutes and regulations and other state rules. 
 
  1. The proposed inclusion of ARM 17.8.102(2) would automatically render certain court-vacated requirements null and void, without the need for rulemaking.
 
  1. The proposal also includes various non-substantive “housekeeping” changes.
 
  1. Interested persons may view the proposed rules on the Department’s website at http://www.deq.mt.gov/meetings.asp or may call the Department at 406-444-7916 to have a copy made available for their inspection.
 
  1. The State of Montana makes reasonable accommodations for any known disability that may interfere with a person’s ability to participate in state government proceedings. Persons needing accommodation must notify Debra Wolfe by calling 406-444-7916 no later than 5:00 p.m., August 29, 2008 to allow adequate time to arrange reasonable accommodation.
 
  1. Interested persons may submit their data, views, or arguments regarding these documents at the hearing. Written data, views, or arguments may also be submitted to Debra Wolfe by mail at: P.O.
